Gibraltar GX11 1AA) shall be subject to the following Terms & Conditions (“Terms”). Nothing in these Terms shall affect a customer’s statutory rights as a consumer.
FORMATION OF CONTRACT OF SALE
(a) The prices stated on this website are either in British pounds sterling (£, GBP) or United States dollars ($, USD) depending on the selected country of delivery. If you wish to purchase any items on this website, you must submit a completed order form. Your order will not be accepted unless you place us in a position of being able to receive full payment for your order at the time we accept it. If we agree to accept your order, we will confirm this by email, then supply the items you have ordered to you in accordance with these Terms. We reserve the right not to accept an order placed by you, in which case you will be notified within 2 business days of receipt of order.
(b) The sale and purchase of products via this website will be governed by a contract between you and us formed when you have placed an order, your order has been accepted by us and we have sent you confirmation of this (the “Contract”). The terms of the Contract will comprise these Terms, as amended or updated by us from time to time, and other relevant information.
(c) You acknowledge and agree that, in entering into a Contract, you do not rely on and have no remedy in respect of, any statement, representation, warranty or understanding (whether negligently or innocently made) of any person (whether party to the Contract or not) which is not expressly set out or referred to in the Contract.
SHIPPING POLICIES
(a) General Shipping Information
All delivery times are quoted in business days which exclude Saturdays, Sundays and Public Holidays and start from the next day after the shipment date. Shipments to certain locations may require additional time in transit. Orders for USA, Canada, Australia and New Zealand are shipped from our warehouse in New Hampshire (USA). Orders for the UK, Europe and the rest of the world are shipped from our warehouse in Lancashire (UK).
USA — Orders must be received by 11.00 a.m. EST for same day shipment. All orders submitted after this time will be processed the next business day.
USPS Media Mail — 2-10 business days
USPS Priority 1 Day — Delivery within one business day
USPS 3 Day — Delivery by the end of the third business day
Australia, Canada and New Zealand— Orders must be received by 11.00 a.m. EST for same day shipment. Orders are shipped by 5 day + courier from our USA warehouse.
UK — Orders must be received by 1 p.m. GMT for same day shipment.
Courier 1-2 Days Service — Deliveries are usually made between 7.00am and 7.00pm Monday to Friday. Delivery is made to an address, not a named individual. When no one is available to accept the item, a card will be left informing the recipient of the attempted delivery. For buildings with multiple occupancy the complete address must contain business name or department details and telephone number to allow a delivery to be completed. Please ensure that the recipient’s telephone number is included.
Europe — Orders are sent from our UK warehouse and must be received by 12.00 a.m. GMT for same day shipment. Orders are shipped by a courier. Tracking number can be emailed upon request. (Please note that Europe contains only selected European countries, those covered by our custom tariff with our couriers. The European countries not listed here can be found in the Rest of the World category.) Tracking Numbers will be emailed upon request.
Rest of the World — Orders are sent from our UK warehouse and must be received by 1p.m GMT for same day shipment. Orders are shipped by a courier. Tracking number can be emailed upon request. Tracking Numbers will be emailed upon request.
(b)Shipping Address
Please ensure that you provide us with the correct shipping address for your order. We cannot be held liable for the loss if your order is lost or not delivered due to incorrect shipping information.
If your order is returned to us because of a wrong address supplied by you, we will make reasonable effort to contact you and rectify the situation. If you choose to have the order shipped again, you will be billed the appropriate shipping charge. If you choose to cancel the order you will be charged up to £7/$10 restocking fee and your shipping charges will not be refunded.
(c) Lost or Damaged International Shipments (excluding UK and USA)
We make every effort to properly package, label and record foreign shipments. Please understand that after an order leaves our warehouse we have no control over it. We cannot be held responsible for the loss or damage of a package once it leaves our store for an international destination.
(d) Customs, Duties and Taxes
Orders sent to addresses outside of the United Kingdom or United States (the location of our warehouses) may be subject to import duties and taxes, which are levied once the package reaches your country. Any additional charges for customs clearance must be borne by you, as these vary from country to country, and we are not able to provide you with this information. Please contact your local customs office before completing the order to find out what fees, if any, may be charged when your package arrives. Please note that you are considered the importer of goods and must comply with all laws and regulations of the country in which you are receiving the goods. Customs authorities may require the value of the order from us.
RETURN POLICY
Upon receipt of your order please open the package immediately and check its contents. If you ordered an item by mistake or received a wrong item, please DO NOT REMOVE THE SHRINK WRAPPING as you may invalidate your right to return the item. All titles can be easily identified either by its cover, back blurb sheet or paper wrap, therefore there is no need to remove the shrink wrapping.
(a) If an item is damaged you must keep the original shipping container and packing materials. If you need to exchange or file a claim for damages or obtain replacements for defective items you are required to notify us within 10 days of receipt of delivery. Do not send any product back without prior approval. If you return an item without prior approval you may be liable for £10/$15 administration fee in addition to shipping charges.
(b) All goods ordered in error, whether already shipped or pending shipping, may be subject of up to £7/$10 re-stocking fee. This fee covers administration time, credit card processing and refunding fees and is only applicable to the goods. Delivery charges are refundable in full, except when goods have been shipped. There are no exceptions to the re-stocking charge. We will issue a refund within 1-3 working days after your cancelation has been acknowledged.

For Orders made through Amazon Marketplace, you will need to send us a formal Return Request via Amazon.
(d) Once your request is authorized, you will be issued with Return Form (RMA) that will need to be printed and included with the returned item(s). At that time you may be asked to ship the product back to us. We reserve the right to determine the return method.
(e) Items in its original condition, i.e. unopened in its shrink wrapping
If an item is being returned to us due to no fault on our part, you will be responsible for returning the item to our warehouse at your expense. We will also deduct the order’s postage cost and a restocking fee of up to £7/$10 from the amount that you have paid.
(f) Used Items (opened and/or taken of its shrink wrapping)
If your item has been opened/used but still in pristine condition and you decide to return it to us for any reason, please note that we will charge a restocking fee which will depend on how much wear and tear the book has undergone and we will also deduct the order’s postage cost from the amount that you have paid. Please note that we reserve the right to refuse returns on opened/used items. You will also be responsible for returning the item to our warehouse at your expense.
(g) Note on books with gilded pages.
Once books with gilded pages are removed from their shrink-wrapping and their pages opened (even if only once), they can no longer be resold because the gilding will have been broken. If you ordered an item by mistake or received the wrong item, please do not remove the shrink wrapping. All of our gilded books come with paper flaps/wraps that clearly identify the title, therefore there is no need to remove the shrink wrapping.
(h) We reserve the right to make the final decision on the condition of the goods. We will issue the refund to your account (card) within 1-3 working days of the receipt and examination of the returned item(s).
(i) Cooling-off Period (UK orders)
Under Gibraltar legislation (Distance Selling Regulations), you have the right to cancel your order for up to seven working days from the day after that on which the books are received by you. To cancel your purchase within the “cooling off” period, please contact us via our ‘Email Enquiry Form’.
LIMITATION OF LIABILITY
You acknowledge and agree that, in no event, shall Haydock Ltd be liable, whether in contract, warranty, tort (including negligence or breach of statutory duty), strict liability, indemnity, contribution, or otherwise, for any indirect, special, punitive, exemplary, incidental or consequential loss, damage, cost or expense of any kind whatsoever, howsoever caused, or for any loss of production, cost of procurement of substitute goods, loss of capital, loss of software, loss of profit, loss of revenues, contracts, business, cost of rework, loss of goodwill or anticipated savings, or wasted management time, even if Haydock Ltd has been advised of the possibility or they are foreseeable. Haydock Ltd’ total liability on all claims, whether in contract, warranty, tort (including negligence or breach of statutory duty), strict liability, indemnity, contribution, or otherwise, shall not exceed the purchase price of goods or content.

MATTERS BEYOND REASONABLE CONTROL
Neither party is liable for any breach of this Agreement that is caused by a matter beyond its reasonable control, including acts of God, fire, lightning, explosion, war, flood, industrial disputes, sabotage, extremely severe weather, or acts of local or central Government or other competent authorities.
GOVERNING LAW AND JURISDICTION
Any sales contract entered into by this website shall be governed under the laws of Gibraltar where it is hereby agreed, that the proper jurisdiction and venue is these said courts in any legal action or proceedings.
